Buying Properties in Thailand. It Is Too Easy.

On Saturday, September 13, 2025, Dr.Sopon Pornchokchai, President, Agency for Real Estate Affairs gave a keynote speech on Buying Properties in Thailand, It is So Easy.

 

Almost no other country in the world allow foreigners to buy properties so freely like in Thailand. It seems that we are selling our land, our nation, our sovereignty.

 

Foreigners Purchase Requirements / Restriction of Properties in Thailand
Buying properties in Thailand is quite easy compared to many countries. Foreigners can buy properties in the following categories.
 

1. Buying land in an industrial estate

 

2. Buying land for 1 rai (1,600 sq.metres or 0.4 acres) to build your own houses if you bring in Baht 40 million (112 Indian Rupee).

 

3. Buying any condominium unit up to 49% of the proportion in a building or project; however, in the case of the Eastern Economic Corridor (EEC), foreigners can buy up to 100%

 

4. If your business is accepted by the Board of Investment, you can buy land for your business for 5 rai (0.8 ha or 1.98 acres), land for your residence for 10 rai (1.6 ha or 3.95 acres) and land for your workers’ living quarters for 20 rai (3.2 ha or 7.91acres). These pieces can be in different locations.

 

5. You can lease properties for typically 30 years but for commercial and industrial uses for 50 years nationwide. In the case of EEC, you can lease for 99 years with two consecutive contracts (50 years and 49 years).

 

6. A "Right Over Leasehold Asset" in Thailand is a legally recognized right over an immovable property (land or building) that grants the holder significant rights similar to ownership for a fixed period, typically up to 30 years and potentially longer through proposed legislation. It is a more secure and robust form of leasehold than a standard lease agreement under the Civil and Commercial Code, allowing for transfer, mortgage, and use as collateral, making it a valuable tool for foreigners. May be extended to 90 – 99 years soon.

 

7. Illegally, you can set up a Thai company to buy Thai house. Many developers set up a company for you.

 

8. You may convert to be a Thai quite easily and can buy a house or with some bribery.

 

9. Some Foreigners can even buy Identification Card !?!

 

10. In the near future, foreigners may own condominium units up to 75% and can lease land anywhere for 90-99 years in Thailand.

 

In addition, Thailand has no buying tax (Singapore 60%, Europe 10-19%). There are also most none for annual property tax (Pay Baht 200 per a million Baht for properties worth more than Baht 50 million of government assessed value (20% - 60% of market value).  Very low capital gain tax (by government assessed value and a lot of exemptions) – not 20% of the gain by market value


Low inheritance tax (subject to pay if the properties is over Baht 100 million levied by government assessed value which is somewhat 20-60% below market value and a lot of exemptions.


Foreigners can also:

- Buy as many as they like.

- No minimum prices

- Not restricted to of-the-plan projects

- Can be together (no random choice).
