The National Park Department has calculated the cost of one black leopard killed in the Thung Yai Forest in the case of Mr. Premchai and his associates to be over 3 million baht. The grey pheasant is worth 22,612 baht, including civil damages of 3,034,612 baht. Researchers have identified only 129 black leopards in Thai forests and are preparing to code and name them.

 

Today (March 22, 2018), the Public Prosecutor's Office has ordered an increase in the assessment of civil damages to the ecosystem in the Thung Yai West Wildlife Sanctuary case, involving Mr. Premchai Karnasuta, CEO of Italian-Thai Development Public Company Limited, and four associates. The Department of National Parks, Wildlife and Plant Conservation has initially assessed civil damages at 3,034,612 baht.

 

Data from this assessment indicates that the killed black leopard, approximately 5 years old, was a subspecies of the Indochinese black leopard. This is a rare and endangered wild animal with a legal status of protected mammals, number 182 according to the Wild Animal Reservation and Protection Act of 1992 and is a wild animal on Appendix 1 of the CITES Convention. The estimated damages were 3,012,000 baht per animal,

It is broken down as follows:

            1. The price of a black leopard in a cage is 462,000 baht, based on a comparison of prices with the price of black leopards purchased by Chiang Mai Night Safari Zoo in 2006.

            2. The cost of implementing a project to release black panthers back into nature (yielding at least 2 tigers) is 1,100,000 baht per year for 5 years. The average cost is 550,000 baht per tiger x 5 years, totaling 2,550,000 baht. This is based on a price comparison with the tiger breeding and genetic conservation project to return tigers to their natural habitat in the Western Forest Complex, Kaeng Krachan Forest Complex, and other conservation forests in the fiscal year 2015 of the Khao Prathap Chang Wildlife Breeding Station.

  

 

As for the Grey Pheasant, it is an adult. Its legal status is as a protected wild animal, number 6, and it is a species that is allowed to be bred according to the Wild Animal Reservation and Protection Act of 1992. The damage cost is 22,612 baht per bird.

 

It is divided as follows:

            1. Price of grey pheasants in cages 10,000 baht and

            2. Price of expenses for the project to release pheasants back into nature. 1 project produces no less than 100 birds, averaging 6,356 baht per bird, referring to the price comparison with the project to breed and expand and release animals back into nature in fiscal year 2015 at Doi Tung Wildlife Breeding Station, Chiang Rai Province.

 

This assessment is based on Section 57. Whoever commits or omits to commit any act in violation of the law that destroys, causes loss or damages natural resources belonging to the state or public property shall be liable to pay damages to the state in the amount of the total value of the natural resources that were destroyed, lost or damaged.

 

 

Prepare code and name the leopard-black panther. 

On March 19th, the Public Prosecutor's Office ordered police to investigate the ecological and environmental damage caused by poaching in the Thung Yai Naresuan Wildlife Sanctuary, west of Kanchanaburi Province. The Wildlife Conservation Office of the Department of National Parks, Wildlife and Plant Conservation initially estimated the damage at over 3 million baht, and Mr. Premchai has been informed of the damage, but he has denied it.

 

Currently, a research team from the Department of National Parks, Mr. Somphon Duangchansiri, head of the Khao Nang Ram Wildlife Research Station, says there are an estimated 129 leopards and black leopards in the Thai forest. In the future, researchers plan to code all leopards and black leopards and name them, similar to the tigers in Huai Kha Khaeng Forest. This will be used for monitoring and researching leopard family groups in Thai forests. They also plan to study the interactions between tigers and leopards in the same area to determine if there is competition for territory.

            วันนี้ (22 มี.ค.2561) จากกรณีที่อัยการให้เพิ่มการประเมินค่าเสียหายทางแพ่งต่อระบบนิเวศในคดีล่าสัตว์ป่าทุ่งใหญ่ฝั่งตะวันตก จ.กาญจนบุรี กับคณะของนายเปรมชัย กรรณสูต ประธานบริหารบริษัท อิตาเลียนไทย ดีเว๊ลอปเมนต์ จำกัด (มหาชน)และพวกรวม 4 คน เบื้องต้นกรมอุทยานแห่งชาติสัตว์ป่าและพันธุ์พืช ประเมินค่าเสียหายทางแพ่งไว้ จำนวน 3,034,612 บาท

            ข้อมูลจากการประเมินครั้งนี้ระบุว่าเสือดำที่ถูกฆ่า 1 ตัวอายุประมาณ 5 ปีเป็นเสือดำ ชนิดย่อยเสือดำอินโดจีน เป็นสัตว์ป่าที่หายากและใกล้สูญพันธุ์ มีสถานภาพทางกฎหมายเป็นสัตว์ป่าคุ้มครองพวกสัตว์เลี้ยงลูกด้วยนม ลำดับ182 ตามพ.ร.บ.สงวนและคุ้มครองสัตว์ป่า พ.ศ.2535 และเป็นสัตว์ป่าบัญชีหมาย เลข 1 ของอนุสัญญาไซเตส คิดค่าเสียหายตัวละ 3,012,000 บาท

 

โดยแยกการประเมินราคาได้ดังนี้
            1.ราคาเสือดำ ในกรงเลี้ยง 1 ตัว ราคา 462,000 บาท อ้างอิงเปรียบเทียบราคากับราคาเสือดำที่สวนสัตว์เชียงใหม่ไนท์ซาฟารีจัดซื้อเมื่อ พ.ศ.2549

            ส่วนไก่ฟ้าหลังเทา 1 ตัวเป็นตัวเต็มวัย สถานภาพทางกฎหมายเป็นสัตว์ป่าคุ้มครองพวกนก ลำดับที่ 6 และเป็นชนิดที่อนุญาตให้เพาะพันธุ์ ได้ตามพ.ร.บ.สงวนและคุ้มครองสัตว์ป่าพ.ศ.2535 คิดค่าเสียหายตัวละ 22,612 บาท
            โดยแยกออกเป็นดังนี้ 1.ราคาไก่ฟ้าหลังเทาในกรงเลี้ยง 10,000 บาท และ 2.ราคาค่าใช้จ่ายในการดำเนินโครงการเพื่อนำไก่ฟ้าปล่อยคืนสู่ธรรมชาติ 1 โครงการได้ผลผลิตไม่น้อยกว่า 100 ตัว เฉลี่ยตัวละ 6,356 บาทอ้างอิงเปรียบเทียบราคากับโครงการเพาะและขยายพันธุ์และปล่อยสัตว์คืนสู่ธรรมชาติปีงบ 2558 ที่สถานีเพาะเลี้ยงสัตว์ป่าดอยตุง จ.เชียงราย
            การประเมินครั้งนี้คิดตามมาตรา 57 ผู้ใดกระทำหรือละเว้นการกระทำด้วยประกาใด โดยมิชิบด้วยกฎหมายอันเป็นการทำลายหรือทำให้สูญหายหรือเสียหายแก่ทรัพยากรธรรมชาติ ซึ่งเป็นของรัฐหรือเป็นสาธารณสมบัติของแผ่นดิน มีหน้าที่ต้องรับผิดชอบชดใช้ค่าเสียหายให้แก่รัฐตามมูลค่าทั้งหมดของทรัพยากรธรรมชาติที่ถูกทำลาย สูญหายหรือเสยหายไป

 

เตรียมทำรหัสและตั้งชื่อเสือดาว-เสือดำ 

            ทั้งนี้เมื่อวันที่ 19 มี.ค.ที่ผ่านมา คณะทำงานอัยการสั่งให้ตำรวจสอบสวนในประเด็นการสร้างความเสียหายต่อระบบนิเวศและสิ่งแวดล้อม ที่เข้าไปล่าสัตว์ป่าในเขตรักษาพันธุ์สัตว์ป่าทุ่งใหญ่นเรศวร ฝั่งตะวันตก จ.กาญจนบุรี เบื้องต้นสำนักอนุรักษ์สัตว์ป่า กรมอุทยานแห่งชาติสัตว์ป่าและพันธุ์พืช ประเมินความเสียหายไว้ที่ 3 ล้านบาทเศษ และให้นายเปรมชัยรับทราบแล้ว แต่ยังให้การปฏิเสธ
            ขณะนี้ ทีมวิจัยกรมอุทยานแห่งชาติ นายสมโภชน์ ดวงจันทราศิริ ห้วหน้าสถานีวิจัยสัตว์ป่าเขานางรำกล่าวว่า เสือดาว-เสือดำในป่าไทยคาดว่ามีประมาณ 129 ตัว ในอนาคตนักวิจัยวางแผนที่ทำรหัสให้กับเสือดาว เสือดำทั้งหมด และตั้งชื่อเสือทุกตัว แบบเดียวกับที่ตั้งชื่อเสือโคร่งทุกตัวในป่าห้วยขาแข้ง เพื่อใช้ในการติดตามวิจัยต่อกลุ่มครอบครัวของเสือดาวในป่าไทย และยังมีแผนที่จะศึกษาการปฎิสัมพันธ์ระหว่างเสือโคร่งกับเสือดาว ในพื้นที่เดียวกันว่ามีการแก่งแย่งพื้นที่กันหรือไม่
